NLB AUCTIONS LTD — SELLER TERMS & CONDITIONS
Once your items have been entered for sale, you will receive a list of your entries by email.
Please check this carefully and contact us as soon as possible if any corrections or amendments are required. Any amendments should be requested no later than 24 hours before the advertised auction start date and time.
NLB Auctions acts as agent for the seller and reserves the right to determine the most appropriate sale, auction date, lot grouping, description, estimate and method of sale for items consigned, unless otherwise agreed in writing.
Seller's commission is charged against the hammer price achieved for each individual lot at the following tiered rates:
Qualifying hallmarked gold, hallmarked silver and luxury watches selling for more than £100 may be charged at a reduced 1% seller's commission.
Eligibility for the special rate is determined by NLB Auctions according to the nature and value of the item.
A £2 lotting fee per lot is charged for items consigned for auction.
This covers cataloguing, photography and illustration.
Where a lot remains unsold, the standard £2 lotting fee will normally be waived.
Bulky or heavy items requiring a two-person lift are subject to a £5 lotting fee regardless of whether the item sells.
There is no additional insurance charge. Insurance is included within NLB Auctions' seller fees.
Every lot offered for auction will normally be photographed and illustrated within our online catalogue published through Easy Live Auction and/or other platforms used by NLB Auctions.
Photographs, videos and descriptions of consigned items may also be used by NLB Auctions for advertising, printed publications, websites, email marketing and social media.
Photography and catalogue illustration charges are included within the applicable lotting fee.
Once an auction catalogue has been published, any lot withdrawn at the seller's request may be subject to a £2.50 administration fee.
NLB Auctions also reserves the right to withdraw an item where we consider it unsuitable for sale, incorrectly described, unsafe, prohibited, damaged or otherwise inappropriate to offer at auction.
Where a reserve has been agreed, this represents the minimum price at which we would normally sell the item and will usually correspond with the lower end of the auction estimate.
All reserves are subject to Auctioneer's Discretion of up to 5% below the agreed reserve, allowing reasonable flexibility to secure a sale.
Where an item remains unsold, NLB Auctions may automatically re-offer the item in the next appropriate auction with the lower estimate / starting price reduced by approximately 25%, unless otherwise agreed with the seller.
Further reductions or changes to the reserve will be discussed or applied where appropriate in order to improve the prospects of sale.
The Auctioneers may also sell by private treaty after the auction any item which failed to sell, provided that the agreed reserve or otherwise authorised selling price is achieved.
Subject to our normal trading conditions, seller payments are normally processed within 21 days following the auction.
Payments are made by BACS bank transfer.
Payments of less than £50 may, by prior arrangement, be settled in cash.
NLB Auctions reserves the right to withhold payment to the seller for any individual lot where cleared payment has not yet been received from the purchaser.
We will make reasonable efforts to obtain outstanding payments from successful bidders as quickly as possible.
Unless arrangements have been made for an item to be re-offered, unsold or withdrawn items should be collected promptly.
Items remaining at NLB Auctions for more than 14 days after notification that they are ready for collection may be subject to storage charges of:
£10 per week, plus a £2.50 administration and insurance charge.
Where goods remain uncollected for an extended period, NLB Auctions reserves the right, following reasonable notice to the seller, to sell, dispose of or otherwise deal with the goods as permitted by law and to deduct reasonable storage, handling, disposal or other associated costs from any proceeds.
NLB Auctions reserves the right to decline or remove from sale any item at any stage, including after it has initially been accepted by a member of staff.
This may include, but is not limited to:
Where practical, the seller will be contacted and given an opportunity to collect such items within an agreed timeframe.
Items found to contain active woodworm or other infestation may be removed from the main saleroom and stored separately or outside to protect other property.
NLB Auctions reserves the right to make a reasonable charge for disposal where an item requires specialist or chargeable disposal.
By consigning goods to NLB Auctions, the seller confirms that they are the legal owner of the goods or are properly authorised by the legal owner to sell them.
The seller agrees to disclose any relevant information concerning ownership, provenance, authenticity, condition or restrictions relating to the goods which may reasonably affect their sale.
NLB Auctions acts as agent for the seller.
The Auctioneers have sole discretion regarding the auction or type of sale into which an item is entered, the way lots are grouped, photography, catalogue descriptions, estimates and presentation, unless otherwise agreed in writing with the seller.
NLB Auctions reserves the right to refuse any item for sale, including an item which has previously been accepted by a member of staff.
Every person entering NLB Auctions' premises does so at their own risk.
NLB Auctions shall not be responsible for accident, injury, damage or loss occurring on its premises except to the extent that such injury, damage or loss results from negligence or another liability which cannot lawfully be excluded.
All goods offered for sale must comply with any applicable consumer protection, product safety and other relevant legislation.
NLB Auctions reserves the right to refuse, withdraw or restrict the sale of any item which we believe may not comply with applicable legal or safety requirements.
Vendors are bound by these Seller Terms & Conditions together with the Conditions of Sale published by NLB Auctions in its auction catalogues, on its website and/or displayed at the saleroom.
By leaving items with NLB Auctions for valuation, consignment or sale, the seller confirms their acceptance of the applicable terms and conditions.
